there cannot be my take. but i'll provide takes in different perspectives so we can understand this in deeper clarity.
this is about bringing the marriage, divorce, maintenance, and other things as a civil thing instead of each religions following their own.
i mean, the British feared implementing this. gonna see how bjp is going to do it. especially since the last few times, their own allies opposed it.
now let's see this from different perspectives
as a religious muslim conservative, you're angry that the government is interfering in your religious customs.
a muslim female conservative or not, might see that other religious counterparts enjoy much better rights when it comes to divorce. they are lengthy legal proceedings and you get alimony + other settlements. no such thing in Muslim personal law. you could be divorced verbally or by an appointed third person. etc.,
(it's important to note that in many indian local communities where locla customs are more prevalent in place among the local Muslim populace, not all aspects of the private Shariah Muslim law in marriage, divorce etc., is followed)
as a feminist or a progressive from any religion, you're more likely to see all of these as something that doesn't give women their rights and basic dignity. you would want a common law that applies for all.
as a Muslim conservative man, you find that it's easy for you - and zero trouble when compared to what your counterparts go through in their marriage in Hindu and other religions in court etc., you hear the alimony, the dark stories, the mental agony etc., and you feel like your religion has already perfected it by making it easy for you.
men in other religions, see this - hey, they don't have the same trouble as us. let us all have the same civil law.
now, india has grown a stage where inter-religious marriages are growing and are becoming common. the only way you can do that is under special marriages act to put it under common civil law or you'd get problems on which personal law you'd follow for matters of dispute..
for judiciary, this is a growing headache. they want UCC for ease.
so whom will you support?
so as a progressive,
A. will you oppose UCC because it tramples on the right of a minority religion by a right wing government since it targets muslims?
or
B. will you seek UCC because it removes away whatever you deem as patriarchal or other religious laws which doesn't guarantee protection to muslim women in terms of marriage, divorce, alimony etc.,
not just women, but also the rights of LGBTQ etc.,
especially since progressives also want to ensure there are inter-religious marriages etc.,
will you not want it to be more inclusive across everyone in india?
which way anon?
-- this is where it lies.
not black and white. but pure grey.
either way, it's tough to implement and I have zero skin in the game in this matter.
i empathize with everyone who feels affected.
for muslims, who feel persecuted, i completely empathize.
but i did write about how these incidents would come out in a detailed manner.
as far as religion, sexual preference - my rules are just simple.
whatever you choose to do inside your home or in your place of worship is nobody else's business.
the world would be a better place if you leave it like that, but unfortunately things don't have a simple solution like it seems.
everyone's angry and everyone needs to be appeased.
